"The Chief Justice and other members of the collegium have, on principle, unanimously agreed that the recommendation for appointment of Mr Justice K.M. Joseph, chief justice, Uttarakhand High Court [PHC: Kerala] as a judge of the Supreme Court should be reiterated".
The judges are of the opinion that Justice Joseph's name should be accompanied by the names of other chief justices of high courts recommended for elevation to the Supreme Court when it is sent back to the government.
The decision was taken at a meeting held today.
The judicial fraternity by and large stood behind justice Joseph with senior-most judge to the apex court J Chelameswar writing to justice Mishra, seeking to convene the Collegium's meeting to urgently forward justice Joseph's name to the Centre.

The SC Collegium, which consists of five senior-most judges - CJI Dipak Misra, Justice Chelameswar, Justice Ranjan Gogoi, Justice M B Lokur and Justice Kurian Joseph - had previously met on May 2 but deferred its decision on the matter. Until then, Justice Joseph's name will not be sent back to the Centre.
Justice Chelameshwar alleged that the administration of the Supreme Court was not in order.The judges claimed to have a written a letter to justice Mishra for which they had not received a reply.
Escalating its conflict with the judiciary, the Modi government last month appointed senior advocate Indu Malhotra as a judge of the apex court, while ignoring the recommendation to elevate Joseph. A wide range of issues relating to appointment of judges from High Courts, which did not have representation, was discussed, which remained inconclusive. The government also flagged the non-representation of SC/STs in the top court judges.
Over a week after it failed to forge a consensus, the Supreme Court collegium Friday unanimously made a decision to reiterate its recommendation to elevate Uttarakhand High Court chief justice K.M. Joseph to the apex court.

Justice Chelameswar, who retires on June 22, was also understood to have responded to all the points raised in the communication to the CJI by Law Minister Ravi Shankar Prasad expressing reservations on the elevation of Justice Joseph.
There has been speculation that Justice Jospeh's name wasn't cleared because he, in 2016, had revoked the president's rule in Uttarakhand, thus enabling the Congress to remain in power, something that did not go down well with the ruling BJP.
"Had it been the case, why would had we approved Justice JS Khehar's name for elevation as CJI previous year", he said, recalling that Justice Khehar was part of the bench which rejected the government's controversial National Judicial Appointments Commission (NJAC) Bill.
